1. Introduction
1.1 Contracting Parties
These Terms constitute a legally binding agreement between you and the operator of EarnNovel, together with its affiliates.
For purposes of these Terms:
“EarnNovel,” “we,” “us,” or “our” means the operator of EarnNovel and its affiliates;
“you” or “user” means any individual or entity that accesses or uses the Services; and
“affiliates” means any entity that directly or indirectly controls, is controlled by, or is under common control with EarnNovel.
1.2 Age Requirements
EarnNovel is not directed to children under the age of 13. Individuals under the age of 13 may not access or use the Services for any purpose.
If you are at least 13 years old but have not reached the age of legal majority in your jurisdiction, you may use the Services only with the consent, supervision, and guidance of your parent or legal guardian. Your parent or legal guardian shall be responsible for your use of the Services to the extent required by applicable law.
1.3 Your Relationship with EarnNovel
These Terms form a legally binding agreement between you and us. Your access to and use of the Services are also subject to our Privacy Policy and any other applicable rules and policies that we may publish from time to time. Such documents form an integral part of these Terms.
2. The Services We Provide
2.1 License to Use the Services
Subject to your continued compliance with these Terms and applicable laws and regulations, EarnNovel grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services and the content made available to you through the Services solely for your personal, non-commercial use.
Except for the rights expressly granted under these Terms, EarnNovel and the relevant rights holders reserve all rights, title, and interests in and to the Services and all related content. Nothing in these Terms transfers any intellectual property rights or other proprietary rights to you.
2.2 Account Registration and Login
You may access certain parts of the Services without registering an account; however, some features or Services may require you to create an account or log in through an authorized third-party platform, such as Google, Facebook, Apple, or another third-party login provider.
You agree to:
provide true, accurate, complete, and up-to-date information when registering, logging in, or using the Services;
ensure that you have the lawful right to use any relevant third-party login account; and
remain responsible for activities conducted under your account.
If you become aware of any unauthorized use of your account, abnormal login activity, or any other circumstance that may compromise the security of your account, you must promptly contact us through the in-app channels or the contact information provided in these Terms.
We reserve the right to suspend, restrict, or terminate your access to part or all of the Services if we reasonably determine that the information you provide is untrue, inaccurate, incomplete, or that your account presents abnormal usage, policy violations, fraud risks, or other security concerns.
2.3 Account Deletion
If you wish to delete your EarnNovel account, you may do so through the account deletion path provided within the app, or you may contact us at feedback@earnnovel.com for assistance.
Once your account is deleted, certain features may no longer be recoverable, and some content, rights, records, rewards, or data that you submitted, stored, or obtained may not be restored or reactivated. Please refer to the in-app instructions, applicable rules, and the Privacy Policy for details.
2.4 Service-Related Communications
You agree that we may provide you with service-related communications by email, in-app notification, pop-up message, internal message, or other reasonable electronic means, including, without limitation, account notices, campaign notices, update notices, legal notices, and other necessary communications. Such electronic communications shall be deemed delivered once sent.
2.5 Software and Updates
If you download, install, or use any software, application, or updated version that we provide, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use such software in accordance with these Terms.
Except to the extent expressly permitted by applicable law, and without our prior written consent, you may not:
copy, modify, adapt, translate, or create derivative works;
decompile, disassemble, reverse engineer, or attempt to extract source code; or
sell, rent, lease, lend, distribute, sublicense, or otherwise make the software available to any third party.
We may provide updates, patches, fixes, or new versions from time to time. Some updates may be installed automatically. If you do not install updates, certain parts of the Services may not function properly or may become unavailable.
2.6 Our Content
The Services may contain text, images, icons, novel content, layout designs, interfaces, audio, video, software, algorithms, identifiers, trademarks, functional modules, virtual items, and other content (collectively, “Our Content”), all of which are owned by EarnNovel or the relevant rights holders and protected by applicable law.
Subject to your compliance with these Terms, we grant you only a limited right to access and use Our Content. Unless we expressly agree otherwise in writing, you may not copy, reproduce, distribute, publicly display, publish, adapt, sell, license, or use Our Content for commercial purposes.
2.7 Advertising and Third-Party Content
In accordance with our Privacy Policy and applicable laws, EarnNovel may display advertisements, promotional materials, or commercial information through the Services, including personalized recommendations. We will identify advertising content where reasonably practicable.
The Services may also contain links to third-party websites, applications, goods, services, or content. Such third-party content is not owned or controlled by EarnNovel, and we make no representation or warranty regarding its availability, legality, accuracy, or security. If you access or use any third-party service, you do so at your own discretion and subject to that third party’s terms and privacy policy.
3. Restrictions on Your Use of the Services
You may not, and may not permit others to:
use the Services in violation of these Terms, applicable laws, regulations, public order, or good morals;
damage, interfere with, attack, disrupt, or attempt to compromise the Services, servers, networks, security mechanisms, or related infrastructure;
access any system, account, data, or service without authorization;
use cheating tools, scripts, emulators, automation tools, exploits, unauthorized third-party software, or other unauthorized technical means to interfere with the Services or obtain improper benefits;
falsify, tamper with, or manipulate reading data, task data, campaign data, device data, location data, or other platform-identifying information;
impersonate others, publish misleading information, engage in harassment, abuse, fraud, traffic manipulation, or otherwise infringe the lawful rights and interests of others;
remove, obscure, or alter any copyright, trademark, or other rights notices contained in the Services;
lend, lease, sell, transfer, sublicense, publicly distribute, or otherwise make available the Services or any portion thereof to any third party;
develop, publish, or use unauthorized plugins, compatibility layers, scraping tools, or other technical components that interoperate with the Services; or
bypass, disable, or undermine any technical measures we use to secure the Services, restrict access, or prevent violations.
If you violate these Terms, we may take such measures as we deem appropriate, including issuing warnings, restricting functions, freezing rewards, removing content, suspending Services, banning accounts, terminating accounts, refusing the issuance of related rewards, recovering improper gains, or pursuing legal remedies.
4. User Content
4.1 Your Content
“Your Content” means any data, text, comments, avatars, images, feedback, information, or other materials that you submit, upload, post, transmit, display, or otherwise make available through the Services.
You must ensure that:
you own or have obtained all necessary rights and permissions to Your Content; and
Your Content, and our use of Your Content as permitted under these Terms, do not infringe any third party’s lawful rights or violate any applicable law or these Terms.
You are solely responsible for Your Content. We recommend that you retain backup copies of any important materials.
4.2 License You Grant to Us
To the extent permitted by applicable law, you grant EarnNovel and its affiliates a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, store, process, adapt, translate, display, distribute, publish, and otherwise exploit Your Content for the purposes of providing, operating, maintaining, promoting, improving, and developing the Services.
Where the functionality of the Services allows other users to view Your Content, you also grant such users a non-exclusive license to access and use Your Content through the Services as contemplated by the applicable functionality.
This authorization shall remain effective to the extent reasonably necessary for the foregoing purposes. Where retention is required by law, for operational reasons, for compliance archiving, or for backup purposes, such rights shall survive your cessation of use of the Services or deletion of your account.
4.3 Content Moderation
We reserve the right, but not the obligation, to review, monitor, block, restrict, refuse to publish, or remove any content that we believe:
violates these Terms, platform rules, or applicable laws;
may harm the Services, other users, or third parties; or
presents risks of illegality, infringement, fraud, harassment, spam, false promotion, or other improper conduct.
Due to technical limitations, system caching, backup mechanisms, or legal compliance requirements, content you delete may not be immediately or fully removed from all locations.
5. Coins, Tasks, and Rewards
5.1 Coins
Coins are virtual reward units made available by EarnNovel through the Services. Users may earn Coins by reading novels, completing designated reading activities, participating in check-in activities, campaigns, incentive-based tasks, rewarded videos, or other activities that EarnNovel may offer from time to time.
The methods of earning Coins, issuance standards, validity period, usage rules, applicable scope, and redeemable content shall be subject to the rules published in the app by EarnNovel from time to time. EarnNovel reserves the right to adjust, restrict, suspend, or terminate Coins-related rules based on product operations, commercial arrangements, risk control needs, or legal and compliance requirements.
Unless EarnNovel expressly states otherwise, Coins:
have no cash value;
may not be redeemed for legal tender;
may not be transferred, sold, gifted, traded, or exchanged between users; and
do not constitute any form of property right, stored value right, or financial asset.
5.2 Tasks and Campaign Rewards
EarnNovel may provide reading tasks, check-in tasks, promotional campaigns, lucky draws, download tasks, rewarded video tasks, surveys, or other activities through which you may earn Coins or other rewards.
EarnNovel reserves the right, at its sole discretion, to determine, adjust, interpret, suspend, or terminate the following with respect to such activities:
activity content;
participation requirements;
reward amounts;
settlement methods;
timing of reward issuance; and
eligibility criteria.
5.3 Improper Acquisition and Risk Control Measures
If we discover, or reasonably suspect, that you have obtained Coins, rewards, or other benefits through cheating, automated tools, false conduct, bulk operations, abnormal device environments, emulators, scripts, exploit abuse, fake invitations, malicious traffic manipulation, organized arbitrage, or any other conduct in violation of these Terms, campaign rules, or applicable law, we may take one or more of the following actions without liability to you:
cancel, deduct, freeze, or invalidate the relevant Coins or rewards;
restrict or revoke your eligibility to participate in the relevant activities;
suspend or terminate your account or certain account functions;
require the return of improperly obtained benefits; and
require you to submit additional explanations or supporting materials for appeal review where necessary.
If you object to any account restriction, reward action, or risk control decision, you may submit an appeal through the in-app channels or by contacting feedback@earnnovel.com. We will review such appeal based on the circumstances, but any decision to restore account functions, rewards, or account status shall be made by us based on the facts, applicable rules, and risk assessment.
6. Promotional Activities
In addition to these Terms, any sweepstakes, contests, limited-time events, promotional plans, or other promotional activities offered by EarnNovel may be subject to separate rules, campaign terms, or supplemental notices. By participating in such activities, you agree to be bound by those additional terms.
If there is any conflict between such specific rules and these Terms, the specific rules shall prevail with respect to the relevant activity.
7. Suspension, Restriction, and Termination
7.1 Changes to the Services
For reasons including product development, operational arrangements, legal compliance, or technical necessity, we may add, remove, modify, interrupt, suspend, or terminate all or part of the Services, features, content, or activities at any time. For material changes, we will provide notice through in-app notification, website announcement, or other reasonable means where reasonably practicable.
7.2 Actions We May Take Against Accounts
If we reasonably believe that:
you have violated these Terms, campaign rules, or applicable laws;
your conduct may harm the lawful rights and interests of EarnNovel, other users, or third parties; or
you present fraud, abuse, infringement, abnormal operations, or other security risks,
we may, without prior notice, restrict login, limit functions, freeze rewards, remove content, suspend use, ban your account, or terminate your account.
7.3 Effect of Termination
Whether your account is deleted by you or restricted, suspended, or terminated pursuant to these Terms, your access to the Services may cease immediately or within a reasonable period. Any loss of related content, records, Coins, rewards, or other data resulting from such termination shall be handled in accordance with these Terms and platform rules to the extent permitted by applicable law.
8. Intellectual Property
All intellectual property rights in the Services, including but not limited to copyrights, trademark rights, patent rights, trade secrets, database rights, interface designs, software code, algorithmic logic, brand identifiers, and other related rights, are owned by EarnNovel or the relevant rights holders.
Without our prior written consent, you may not use our trademarks, brands, logos, domain names, product names, or other distinctive commercial identifiers in any form.
If you believe that any content in the Services infringes your lawful intellectual property rights, please contact us at feedback@earnnovel.com and provide the necessary details.
9. Disclaimer
To the fullest extent permitted by applicable law, the Services are provided on an “as is,” “as available,” and “with all faults” basis. Except as expressly required by law, we make no express or implied warranties regarding, among other things:
that the Services will always be available, continuous, uninterrupted, error-free, or delay-free;
that the Services will fully meet your needs or any particular purpose;
that any content, recommendations, results, data, or functionality made available through the Services will always be accurate, complete, reliable, or timely; or
that the Services will be free from viruses, malicious code, hacking incidents, system failures, or other security risks.
You understand and agree that, due to network conditions, device failures, interruption of third-party services, system maintenance, force majeure, regulatory requirements, or other causes beyond our reasonable control, the Services may be interrupted, malfunction, be delayed, experience data loss, or involve delayed reward issuance. To the extent permitted by applicable law, we shall not be liable for any losses arising therefrom.
10. Limitation of Liability
To the fullest extent permitted by applicable law, the aggregate liability of EarnNovel and its affiliates arising out of or in connection with these Terms or the Services shall not exceed US$100 or the equivalent amount in Hong Kong dollars.
To the fullest extent permitted by applicable law, neither EarnNovel nor its affiliates shall be liable for:
any indirect, incidental, special, punitive, or consequential damages;
any loss of profits, loss of revenue, loss of goodwill, loss of opportunity, loss of data, or loss of content;
any losses caused by natural disasters, war, riots, government actions, cyberattacks, viruses, device failures, third-party failures, or other causes beyond our reasonable control; or
any losses caused by your breach of these Terms, improper use of the Services, or unauthorized use of the Services.
Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law, including liability arising from fraud or from our gross negligence or willful misconduct where such liability may not lawfully be excluded.
11. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless EarnNovel, its affiliates, directors, officers, employees, partners, and agents from and against any claims, actions, proceedings, investigations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
your use of the Services;
Your Content;
your violation of these Terms, campaign rules, or applicable law; or
your infringement of any lawful rights or interests of any third party.
12. Governing Law and Dispute Resolution
These Terms, and any formation, validity, interpretation, performance, and dispute arising out of or in connection with these Terms or the Services, shall be governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be resolved through good-faith negotiations between the parties. If such negotiations fail, the dispute shall be referred to the Hong Kong International Arbitration Centre (HKIAC) and finally resolved by arbitration in Hong Kong in accordance with the HKIAC Administered Arbitration Rules in force at the time the Notice of Arbitration is submitted.
Unless otherwise required by applicable law, the arbitral award shall be final and binding upon both parties.
13. Changes to These Terms
We may revise these Terms from time to time in response to changes in laws, regulatory requirements, product developments, commercial arrangements, or service adjustments.
If these Terms are materially changed, we will notify you through in-app announcements, pop-ups, website notices, email, or other reasonable means where reasonably practicable. Unless otherwise specified, the revised Terms shall take effect on the date of publication or on the effective date stated in the notice. Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the revised Terms.

1. Introducción
1.1 Partes contratantes

“EarnNovel”, “nosotros”, “nos” o “nuestro(s)/nuestra(s)” significa el operador de EarnNovel y sus afiliadas;

“afiliadas” significa cualquier entidad que directa o indirectamente controle a EarnNovel, sea controlada por EarnNovel o se encuentre bajo control común con EarnNovel.

2.4 Comunicaciones relacionadas con el servicio
Usted acepta que podamos enviarle comunicaciones relacionadas con el servicio por correo electrónico, notificaciones dentro de la aplicación, mensajes emergentes, mensajes internos u otros medios electrónicos razonables, incluyendo, entre otros, avisos de cuenta, avisos de campañas, avisos de actualizaciones, avisos legales y otras comunicaciones necesarias. Si usted accede o utiliza cualquier servicio de terceros, lo hará a su propia discreción y sujeto a los términos y la política de privacidad de dicho tercero.
3. Restricciones sobre su uso de los Servicios
Usted no podrá, ni permitirá que otros:
utilicen los Servicios en violación de estos Términos, de las leyes o regulaciones aplicables, del orden público o de las buenas costumbres;
dañen, interfieran, ataquen, perturben o intenten comprometer los Servicios, los servidores, las redes, los mecanismos de seguridad o la infraestructura relacionada;
accedan sin autorización a cualquier sistema, cuenta, dato o servicio;
utilicen herramientas de trampa, scripts, emuladores, herramientas de automatización, exploits, software no autorizado de terceros u otros medios técnicos no autorizados para interferir con los Servicios u obtener beneficios indebidos;
falsifiquen, alteren o manipulen datos de lectura, datos de tareas, datos de campañas, datos del dispositivo, datos de ubicación u otra información identificativa de la plataforma;
suplanten a terceros, publiquen información engañosa, incurran en acoso, abuso, fraude, manipulación de tráfico o infrinjan de cualquier otra forma los derechos e intereses legítimos de terceros;
eliminen, oculten o alteren cualquier aviso de derechos de autor, marca registrada u otros avisos de derechos contenidos en los Servicios;
presten, arrienden, vendan, transfieran, sublicencien, distribuyan públicamente o pongan de cualquier otra forma los Servicios o cualquier parte de los mismos a disposición de terceros;
desarrollen, publiquen o utilicen complementos no autorizados, capas de compatibilidad, herramientas de scraping u otros componentes técnicos que interactúen con los Servicios; o
eludan, desactiven o menoscaben cualesquiera medidas técnicas que utilicemos para proteger los Servicios, restringir el acceso o prevenir incumplimientos.
Si usted incumple estos Términos, podremos adoptar las medidas que consideremos apropiadas, incluyendo emitir advertencias, restringir funciones, congelar recompensas, eliminar contenido, suspender los Servicios, bloquear cuentas, cancelar cuentas, negar la entrega de recompensas relacionadas, recuperar beneficios obtenidos indebidamente o ejercer las acciones legales correspondientes.
4. Contenido del usuario
4.1 Su contenido
“Su Contenido” significa cualquier dato, texto, comentarios, avatares, imágenes, opiniones, información u otros materiales que usted envíe, cargue, publique, transmita, muestre o ponga de cualquier otra forma a disposición a través de los Servicios.
Usted deberá asegurarse de que:
es titular o ha obtenido todos los derechos y permisos necesarios sobre Su Contenido; y
Su Contenido, así como nuestro uso de Su Contenido conforme a estos Términos, no infringen los derechos legítimos de terceros ni violan ninguna ley aplicable ni estos Términos.
Usted es el único responsable de Su Contenido. Le recomendamos conservar copias de respaldo de cualquier material importante.
4.2 Licencia que usted nos otorga
En la medida permitida por la legislación aplicable, usted otorga a EarnNovel y a sus afiliadas una licencia mundial, no exclusiva, libre de regalías, transferible y sublicenciable para usar, reproducir, almacenar, procesar, adaptar, traducir, mostrar, distribuir, publicar y explotar de cualquier otra forma Su Contenido con el fin de proporcionar, operar, mantener, promover, mejorar y desarrollar los Servicios.
Cuando la funcionalidad de los Servicios permita a otros usuarios ver Su Contenido, usted también otorga a dichos usuarios una licencia no exclusiva para acceder y utilizar Su Contenido a través de los Servicios conforme a la funcionalidad aplicable.
Esta autorización permanecerá vigente en la medida razonablemente necesaria para los fines anteriores. Cuando la conservación sea requerida por ley, por razones operativas, por archivo de cumplimiento o por fines de respaldo, dichos derechos subsistirán a la terminación de su uso de los Servicios o a la eliminación de su cuenta.
4.3 Moderación de contenido
Nos reservamos el derecho, pero no la obligación, de revisar, monitorear, bloquear, restringir, rechazar la publicación o eliminar cualquier contenido que consideremos que:
viola estos Términos, las reglas de la plataforma o las leyes aplicables;
puede dañar los Servicios, a otros usuarios o a terceros; o
presenta riesgos de ilegalidad, infracción, fraude, acoso, spam, promoción falsa u otra conducta indebida.
Debido a limitaciones técnicas, almacenamiento en caché del sistema, mecanismos de respaldo o requisitos de cumplimiento legal, el contenido que usted elimine podría no ser retirado de inmediato o por completo de todas las ubicaciones.
5. Coins, tareas y recompensas
5.1 Coins
Los Coins son unidades virtuales de recompensa que EarnNovel pone a disposición a través de los Servicios. Los usuarios pueden obtener Coins al leer novelas, completar actividades de lectura designadas, participar en actividades de registro diario, campañas, tareas con incentivos, videos recompensados u otras actividades que EarnNovel pueda ofrecer ocasionalmente.
Los métodos para obtener Coins, los criterios de emisión, el periodo de vigencia, las reglas de uso, el alcance aplicable y el contenido canjeable estarán sujetos a las reglas publicadas en la aplicación por EarnNovel de tiempo en tiempo. EarnNovel se reserva el derecho de ajustar, restringir, suspender o terminar las reglas relacionadas con los Coins en función de la operación del producto, arreglos comerciales, necesidades de control de riesgos o requisitos legales y de cumplimiento.
Salvo que EarnNovel indique expresamente lo contrario, los Coins:
no tienen valor en efectivo;
no pueden canjearse por moneda de curso legal;
no pueden transferirse, venderse, regalarse, comercializarse ni intercambiarse entre usuarios; y
no constituyen ninguna forma de derecho patrimonial, derecho de valor almacenado o activo financiero.
5.2 Tareas y recompensas de campañas
EarnNovel podrá proporcionar tareas de lectura, tareas de registro diario, campañas promocionales, sorteos, tareas de descarga, tareas de video recompensado, encuestas u otras actividades mediante las cuales usted podrá obtener Coins u otras recompensas.
EarnNovel se reserva el derecho, a su entera discreción, de determinar, ajustar, interpretar, suspender o terminar lo siguiente con respecto a dichas actividades:
el contenido de la actividad;
los requisitos de participación;
los montos de recompensa;
los métodos de liquidación;
el momento de entrega de las recompensas; y
los criterios de elegibilidad.
5.3 Obtención indebida y medidas de control de riesgos
Si descubrimos, o sospechamos razonablemente, que usted ha obtenido Coins, recompensas u otros beneficios mediante trampas, herramientas automatizadas, conductas falsas, operaciones masivas, entornos anormales de dispositivos, emuladores, scripts, abuso de vulnerabilidades, invitaciones falsas, manipulación maliciosa de tráfico, arbitraje organizado u otra conducta que infrinja estos Términos, las reglas de campañas o la legislación aplicable, podremos adoptar una o varias de las siguientes medidas sin responsabilidad frente a usted:
cancelar, deducir, congelar o invalidar los Coins o recompensas correspondientes;
restringir o revocar su elegibilidad para participar en las actividades correspondientes;
suspender o cancelar su cuenta o determinadas funciones de la cuenta;
exigir la devolución de los beneficios obtenidos indebidamente; y
requerirle explicaciones adicionales o documentación de respaldo para la revisión de una apelación, cuando sea necesario.
Si usted no está de acuerdo con alguna restricción de cuenta, medida sobre recompensas o decisión de control de riesgos, podrá presentar una apelación a través de los canales dentro de la aplicación o comunicándose a feedback@earnnovel.com. Revisaremos dicha apelación conforme a las circunstancias, pero cualquier decisión de restablecer funciones de la cuenta, recompensas o el estado de la cuenta será tomada por nosotros con base en los hechos, las reglas aplicables y la evaluación de riesgos.
6. Actividades promocionales
Además de estos Términos, cualesquiera sorteos, concursos, eventos por tiempo limitado, planes promocionales u otras actividades promocionales ofrecidas por EarnNovel podrán estar sujetos a reglas independientes, términos de campaña o avisos complementarios. Al participar en dichas actividades, usted acepta quedar obligado también por esos términos adicionales.
Si existe algún conflicto entre esas reglas específicas y estos Términos, prevalecerán las reglas específicas con respecto a la actividad correspondiente.
7. Suspensión, restricción y terminación
7.1 Cambios en los Servicios
Por motivos tales como desarrollo del producto, arreglos operativos, cumplimiento legal o necesidad técnica, podremos agregar, eliminar, modificar, interrumpir, suspender o terminar la totalidad o parte de los Servicios, funciones, contenido o actividades en cualquier momento. Cuando resulte razonablemente practicable, notificaremos cambios sustanciales mediante notificación dentro de la aplicación, anuncio en el sitio web u otros medios razonables.
7.2 Medidas que podremos tomar respecto de cuentas
Si consideramos razonablemente que:
usted ha infringido estos Términos, las reglas de campañas o las leyes aplicables;
su conducta puede perjudicar los derechos e intereses legítimos de EarnNovel, de otros usuarios o de terceros; o
usted presenta fraude, abuso, infracción, operaciones anormales u otros riesgos de seguridad,
podremos, sin previo aviso, restringir el inicio de sesión, limitar funciones, congelar recompensas, eliminar contenido, suspender el uso, bloquear su cuenta o cancelarla.
7.3 Efectos de la terminación
Ya sea que su cuenta sea eliminada por usted o restringida, suspendida o cancelada conforme a estos Términos, su acceso a los Servicios podrá cesar de inmediato o dentro de un plazo razonable. Cualquier pérdida de contenido relacionado, registros, Coins, recompensas u otros datos derivada de dicha terminación se manejará de conformidad con estos Términos y las reglas de la plataforma, en la medida permitida por la legislación aplicable.
8. Propiedad intelectual
Todos los derechos de propiedad intelectual sobre los Servicios, incluidos, entre otros, derechos de autor, derechos de marcas, derechos de patente, secretos industriales, derechos sobre bases de datos, diseños de interfaz, código de software, lógica algorítmica, identificadores de marca y otros derechos relacionados, pertenecen a EarnNovel o a los titulares de derechos correspondientes.
Sin nuestro consentimiento previo por escrito, usted no podrá utilizar nuestras marcas, nombres comerciales, logotipos, nombres de dominio, nombres de productos u otros identificadores comerciales distintivos en ninguna forma.

9. Exclusión de garantías
En la máxima medida permitida por la legislación aplicable, los Servicios se proporcionan “tal cual”, “según disponibilidad” y “con todos sus defectos”. Salvo en la medida expresamente exigida por la ley, no otorgamos garantías expresas ni implícitas con respecto, entre otros aspectos, a:
que los Servicios estarán siempre disponibles, serán continuos, ininterrumpidos, libres de errores o de retrasos;
que los Servicios satisfarán plenamente sus necesidades o algún fin particular;
que cualquier contenido, recomendación, resultado, dato o funcionalidad disponible a través de los Servicios será siempre exacto, completo, confiable u oportuno; o
que los Servicios estarán libres de virus, código malicioso, incidentes de hacking, fallas del sistema u otros riesgos de seguridad.
Usted entiende y acepta que, debido a condiciones de red, fallas de dispositivos, interrupción de servicios de terceros, mantenimiento del sistema, fuerza mayor, requisitos regulatorios u otras causas fuera de nuestro control razonable, los Servicios pueden interrumpirse, funcionar incorrectamente, sufrir retrasos, experimentar pérdida de datos o implicar retrasos en la entrega de recompensas. En la medida permitida por la legislación aplicable, no seremos responsables por las pérdidas derivadas de lo anterior.
10. Limitación de responsabilidad
En la máxima medida permitida por la legislación aplicable, la responsabilidad total acumulada de EarnNovel y sus afiliadas derivada de o relacionada con estos Términos o con los Servicios no excederá de 100 dólares estadounidenses o su equivalente en dólares de Hong Kong.
En la máxima medida permitida por la legislación aplicable, ni EarnNovel ni sus afiliadas serán responsables por:
cualesquiera daños indirectos, incidentales, especiales, punitivos o consecuenciales;
cualquier pérdida de ganancias, pérdida de ingresos, pérdida de buena reputación, pérdida de oportunidades, pérdida de datos o pérdida de contenido;
cualesquiera pérdidas causadas por desastres naturales, guerra, disturbios, actos gubernamentales, ciberataques, virus, fallas de dispositivos, fallas de terceros u otras causas fuera de nuestro control razonable; o
cualesquiera pérdidas causadas por su incumplimiento de estos Términos, uso indebido de los Servicios o uso no autorizado de los Servicios.
Nada de lo dispuesto en estos Términos excluirá o limitará cualquier responsabilidad que no pueda excluirse o limitarse conforme a la legislación aplicable, incluida la responsabilidad derivada de fraude o de nuestra negligencia grave o conducta dolosa, cuando dicha responsabilidad no pueda excluirse legalmente.
11. Indemnización
En la medida permitida por la legislación aplicable, usted acepta indemnizar, defender y mantener en paz y a salvo a EarnNovel, sus afiliadas, directores, funcionarios, empleados, socios y agentes frente a cualesquiera reclamaciones, acciones, procedimientos, investigaciones, pérdidas, responsabilidades, costos y gastos (incluidos honorarios razonables de abogados) que surjan de o se relacionen con:
su uso de los Servicios;
Su Contenido;
su incumplimiento de estos Términos, de las reglas de campañas o de la legislación aplicable; o
su infracción de cualesquiera derechos o intereses legítimos de terceros.
12. Ley aplicable y solución de controversias
Estos Términos, así como cualquier cuestión relacionada con su celebración, validez, interpretación, cumplimiento y cualquier controversia que surja de o en relación con estos Términos o con los Servicios, se regirán por las leyes de la Región Administrativa Especial de Hong Kong, sin atender a sus principios sobre conflictos de leyes.
Cualquier disputa, reclamación o controversia que surja de o se relacione con estos Términos o con los Servicios deberá resolverse primero mediante negociaciones de buena fe entre las partes. Si dichas negociaciones no prosperan, la controversia se remitirá al Hong Kong International Arbitration Centre (HKIAC) y se resolverá definitivamente mediante arbitraje en Hong Kong de conformidad con las HKIAC Administered Arbitration Rules vigentes al momento en que se presente la Notificación de Arbitraje.
Salvo que la legislación aplicable disponga lo contrario, el laudo arbitral será definitivo y vinculante para ambas partes.
13. Modificaciones a estos Términos
Podremos revisar estos Términos de tiempo en tiempo en respuesta a cambios en la legislación, requisitos regulatorios, desarrollos del producto, arreglos comerciales o ajustes en los Servicios.
Si estos Términos se modifican de manera sustancial, se lo notificaremos mediante anuncios dentro de la aplicación, mensajes emergentes, avisos en el sitio web, correo electrónico u otros medios razonables, cuando ello resulte razonablemente practicable. Salvo que se indique lo contrario, los Términos revisados entrarán en vigor en la fecha de su publicación o en la fecha de vigencia indicada en el aviso. Su uso continuado de los Servicios después de la entrada en vigor de los Términos actualizados constituirá su aceptación de los mismos.
